No motor vehicle, defined to be a vehicle which is self-propelled,
except an electric personal assistive mobility device or a vehicle
which is propelled solely by human power, pursuant to the Pennsylvania
Motor Vehicle Code (Title 75, Part I, Chapter 1, § 102 of
the Pennsylvania Code), shall be operated on the streets, roads, alleys
or highways (hereinafter "streets") listed below within the Borough
of Stockertown, Northampton County, Pennsylvania, utilizing, in said
operation, an engine brake or engine suppression or compression brake.
The streets subject to this prohibition shall be as follows:
A.
State Route 2025, known as Main Street, beginning at the Borough
of Stockertown municipal boundary adjoining Forks Township, Northampton
County, Pennsylvania, and continuing west-by-northwest to the intersection
with State Route 191, known as Industrial Boulevard for southbound
traffic and Main Street for northbound traffic.
B.
State Route 191, known as Main Street for southbound traffic, beginning
at the Borough of Stockertown municipal boundary adjoining Plainfield
Township, Northampton County, Pennsylvania, and continuing south-by-southeast
to the intersection with State Route 2025, known as Main Street, and
State Route 191, known as Industrial Boulevard.
C.
State Route 191, known as Industrial Boulevard for northbound traffic,
beginning at the municipal boundary with Upper Nazareth Township,
Northampton County, Pennsylvania, and continuing northeast to the
intersection of State Routes 191 and 2025, known as Main Street.
D.
State Route 191, known as Industrial Boulevard for southbound traffic,
beginning at the intersection of State Routes 191 and 2025, known
as Main Street, and continuing southwest to a point approximately
230 feet past the intersection with the southbound Route 33 exit ramp.
This article shall not apply to emergency driving situations
requiring the utilization of an engine brake to protect the safety
and property of the residents of the Borough of Stockertown, other
motor vehicle operators, pedestrians, and the operator and passengers
of the motor vehicle involved in said emergency situation.
Any person, corporation, partnership or legal entity violating
any of the provisions of this article shall, upon conviction thereof,
be sentenced to pay a fine of not more than $300 and costs of prosecution,
and, in default of the payment thereof, shall be sentenced to undergo
imprisonment for a period not to exceed 90 days. Every day that a
violation under this article continues shall constitute a separate
offense.
This article shall become effective upon final enactment.
The provisions of this article shall be severable, and if any
of its provisions shall be held to be unconstitutional, illegal or
invalid, or otherwise unenforceable by a court of competent jurisdiction,
the remaining portions shall not be affected hereby.
