Subject to additional definitions contained within this article,
words and phrases used in the Vehicle Code, 75 Pa.C.S.A. § 102,
when used in this article, shall have, unless the context clearly
indicates otherwise, the meanings given to them in the aforesaid section
of the Vehicle Code.
Pursuant to the powers granted under the Vehicle Code, Borough
Council shall regulate, restrict and prohibit traffic and parking
in limited areas for limited times within the Borough of Stockertown
in the case of fire, flood, storm, snow emergency or other emergency,
in order to facilitate private or public works, in order to facilitate
processions and public events, and to create play highways whereupon
sledding and coasting shall be permitted. In the event of fire, flood,
storm, snow emergency or other emergency, the Chief of Police shall
have the authority to regulate, restrict, and prohibit traffic and
parking in limited areas for limited times. In all other cases, Borough
Council is hereby authorized to implement such regulations by resolution.
Police Officers, designated and appointed by Borough Council,
and Special Fire Police, with the specific authorization of the Chief
of Police, are hereby authorized, subject to the supervision and control
of Borough Council, to direct traffic and provide traffic control
on all highways and roads within the Borough, and to enforce the ordinances
of the Borough of Stockertown and the statutes of the Commonwealth
of Pennsylvania.
Snow emergency routes, is hereby repealed.
Police Officers, designated and appointed by the Borough of
Stockertown, are hereby authorized to removed from the right-of-way
of any state highway or Borough road within the Borough of Stockertown
any vehicle which is parked in violation of the provisions of this
article when said Police Officer determines such removal necessary
to facilitate the removal or plowing of snow or for any other lawful
purpose. Such vehicle will be impounded by the Borough of Stockertown
and the owner shall pay to the Borough an impoundment fee in an amount
as set by resolution of the Borough Council and the costs of removal
of the vehicle. Payment for storage is the responsibility of the owner
of said vehicle.
No vehicle shall be stored upon any street or alley within the
Borough of Stockertown. As used herein, "stored" shall mean the parking
of a motor vehicle in one place upon a street or alley continuously
for a period in excess of 24 hours. In addition to such other definitions
of "motor vehicle" as contained in the Vehicle Code, the storage of
any object, including trailers, watercraft, shall be considered a
violation of this provision.
No person shall park or store a motor vehicle upon any street
or alley in the Borough of Stockertown for the purposes of greasing
or repairing said vehicle.
The parking of motor vehicles, or the placement of other objects
within the rights-of-way of the following locations is hereby prohibited:

Borough Council shall authorize the Borough Roadmaster to erect
and maintain appropriate regulatory signs according to law including
road markers in those areas where parking is prohibited.
Any person who violates any provisions of this article shall pay a fine of $30 per day per violation.  Provided: It shall be the duty of the Police Officers or of parking enforcement personnel of the Borough to report to the Police Department of the Borough indicating, in each case: the section violated; the license number of the vehicle involved in the violation; the location where the violation took place; the date and time of such violation; and such other facts the officer might deem necessary in order to secure a clear understanding of the circumstances attending the violation of this article.  The notice shall contain instructions to the owner or driver of the vehicle that if he/she will report to the Police Department or the Municipal Building at 209 Main Street and pay the sum of $30 within five days after the time of the notice, that act will save the violator from prosecution and from payment of the fine and costs proscribed in this section.  In the event of any prosecution under this article, a default of the payment of any fines and costs required will require the violator to undergo imprisonment in Northampton County Prison for not more than five days.
