§ 228-8 Word usage.

Words and phrases, when used in this article, shall have the meanings ascribed to them in the Vehicle Code of the Commonwealth of Pennsylvania,

as now in force or as hereafter amended, enacted or reenacted, except in those instances where the context clearly indicates a different meaning. The singular shall include the plural, and the masculine shall include the feminine.

§ 228-9 Authority of Mayor.

The Mayor of the Borough is hereby granted power to regulate, restrict and prohibit traffic and parking for limited times on the rights-of-way of any state highway or Borough road within the Borough of Stockertown in the event of a snow emergency.

§ 228-10 Definitions.

As used in this article, certain terms are defined as follows:

SNOW
Any precipitation depositing any accumulation on the streets and highways, including snow, sleet, hail, ice and freezing rain.
SNOW EMERGENCY
A state of highway condition that is hazardous and dangerous to vehicular and pedestrian traffic and is so declared by the Mayor of the Borough or his/her designee.

§ 228-11 Declaration of snow emergency.

In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the streets, roads, and highways of the Borough of Stockertown, the Mayor, in his/her discretion, may declare a snow and ice emergency, designated in this article as a "snow emergency." Information on the existence of a snow emergency may be given by the Borough through radio, newspaper, or other available media, and information on the termination or modification of the emergency may be given by use of the same media.

§ 228-12 Parking restrictions.

Upon declaration of a snow emergency, it shall be unlawful at any time during the continuation of the snow emergency for any person to park or leave unattended a motor vehicle or to allow that vehicle to remain parked or unattended anywhere on the roadways, streets, highways, or rights-of-way of any state or Borough road within the Borough of Stockertown.

§ 228-13 Depositing snow on roads prohibited.

It shall be unlawful to blow snow or deposit snow on the roadways, streets, highways, or rights-of-way of any state or Borough road within the Borough of Stockertown at any time.

§ 228-14 Removal of vehicles.

Any vehicle parked, stalled, incapable of moving under its own power, or left unattended upon any roadway, street, highway, or right-of-way of any state or Borough road within the Borough of Stockertown during a snow emergency shall be removed or towed to any other location upon order of the Police Department at the owner's expense.

§ 228-15 Violations and penalties.

Any person or persons, firm or corporation violating any of the provisions of this article shall upon conviction, be liable to and shall pay a fine or penalty of not more than $600 plus costs for every violation, for the use of the Borough, and, in default of payment of such fine and costs, imprisonment for a term not exceeding 30 days.
