§ 26-5 Incorporation of purpose clauses.

The above purpose clauses are hereby adopted and made a part of this article by this reference.

§ 26-6 Agreements for implementation of solid waste management plan.

The Borough is hereby empowered to enter into agreements with other municipalities or other public bodies in Northampton County for the purpose of establishing cooperation among such municipalities towards the completion and implementation of a solid waste management plan as long as the parties adhere to the following terms:

A.

The Borough will commit itself to participation as an active member in the solid waste management process.

B.

The Borough shall designate Northampton County to prepare the solid waste management plan.

C.

The Borough shall cooperate with the participating entities in approving a budget and other related fiscal activities necessary to undertake this planning process.

D.

The Borough shall agree to share in the costs of the planning process on a per-capita basis; the per-capita amount shall be agreed upon by a simple majority of participating municipalities.

E.

The Borough shall agree to designate an individual to serve as the municipal representative to the Municipal Conference, which body shall serve to insure that each municipality will participate in the preparation of and review of the solid waste management plan.

§ 26-7 Authority execute documents and agreements.

The proper officers and other personnel of Borough are hereby authorized and empowered to take all such further action and execute such additional documents, including the necessary agreements between the county and the municipalities and other public bodies which decide to enter into the aforesaid program, as they may deem appropriate to carry out the purpose of this article.

§ 26-8 Authorization of officers.

§ 26-9 Right to withdraw.

Notwithstanding anything contained in this article to the contrary, the Borough reserves the right to withdraw from participation with Northampton County and other municipalities involved in the completion and implementation of the solid waste management plan as proposed in this article upon giving 60 days' written notice to Northampton County, Pennsylvania.
