As used in this chapter, the following terms shall have the
meanings indicated:
- PARKS, RECREATION AREAS AND PUBLIC PROPERTY
- Includes all parks, playgrounds, recreation areas and public
property now or hereafter owned or maintained by the Borough of Stockertown,
Northampton County, Pennsylvania. The following areas are intended
to include, but shall not limit, those areas owned by the Borough
of Stockertown which are hereby specifically designated as playgrounds,
parks, recreational areas or public places:

From and after the date of this chapter, the parks, recreation
areas and public property located in the Borough of Stockertown shall
be supervised and maintained by a park commission to be known as the
"Stockertown Park Commission."
The Stockertown Park Commission shall have authority to supervise
and maintain the parks, recreation areas and public property within
the Borough of Stockertown, Northampton County, Pennsylvania, subject
to approval by the Council of the Borough of Stockertown, and shall
have the power to promulgate rules, regulations and policy relative
to the use, operation, maintenance, and management of said parks and
playgrounds in addition to the rules and regulations set forth in
this chapter. All persons visiting any of said parks, recreation areas
and public property shall be subject to said rules and regulations.
The Stockertown Park Commission shall consist of five persons,
all of whom shall be appointed by the Council of the Borough of Stockertown
with each member serving for a term of five years, with terms staggered
so that no two members of the Commission shall be selected in any
year except for the first year, at which time one member shall be
selected for a five-year term, the second member shall be selected
for a four-year term, the third member shall be selected for a three-year
term, the fourth member shall be selected for a two-year term, and
the fifth member shall be selected for a one-year term.
The Stockertown Park Commission shall be accountable to the
Council of the Borough of Stockertown regarding the operation, maintenance
and management of the parks, recreation areas and public property
located in the Borough of Stockertown and shall submit to Council
on or before the first Monday in October of each year the budget for
the succeeding year and shall submit to the Council annually, with
said proposed budget, an account showing all receipts and disbursements
and a balance statement for the preceding year reflecting the operation
of the said Commission.
A. The rules
and regulations herein set forth apply to all parks, recreation areas
and public property. No Borough-owned property shall be used for any
purpose without the prior authorization of the Borough Park Commission.
B. The said
parks, recreation areas and public property are for the benefit and
pleasure of the residents of the Borough of Stockertown, Pennsylvania,
and all persons, firms, corporations, partnerships or legal entities
who use the said facilities shall be subject to the rules and regulations
herein set forth and any amendments thereto.
A. All parks and recreation areas, as defined in this chapter, shall
be closed between the hours of 10:00 p.m. and 8:00 a.m. Any person,
firm, corporation, partnership or legal entity found within any such
park or recreation area during the hours when it shall be closed,
as herein provided, shall be guilty of a violation of this chapter
and, upon conviction thereof, shall be subject to the penalties herein
provided.
B. This section shall not apply to persons within such parks or recreation
areas who are members of a group who have obtained approval from the
Borough Park Commission to use such recreation areas and parks and
who have also registered the time, date, place and nature of their
activity with the Borough Park Commission.
Driving or parking of automobiles or of any other vehicle shall
be permitted only on the paved roadways or clearly designated places
within said parks or recreation areas, unless otherwise directed by
the police or the Mayor of the Borough of Stockertown or the Borough
Park Commission.
No person, firm, corporation, partnership or legal entity shall,
at any time, use any portion of any Borough land or property designated
as a park, playground, recreation area or public property for any
purpose other than recreational, without the prior specific authorization
of the Borough Park Commission. The following are listed only as examples
of the kinds of activities that are specifically prohibited:
A. Commit any disorderly or immoral act.
C. Drink any alcoholic beverages except by permission of the Park Commission.
D. Throw stones or missiles.
E. Hit or drive a golf ball.
F. Publicly solicit subscriptions.
G. Allow any animal on any athletic field during any athletic event,
or to bring any dog into any recreation area or park or to allow any
dog to remain in any recreation area or park at any time.
H. Throw, deposit or drain any offensive substance of any kind or deposit
paper, fruit, refuse, lunch baskets or other refuse in any place,
save in receptacles provided therefor.
I. Sleep on the ground or elsewhere, except in such places and at such
times which may be designated by the Borough Council.
J. Utter loud, profane, offensive and indecent language.
K. Setting off fire works or rockets without the specific permission
of the Borough Council.
L. The driving or riding of automobiles, snowmobiles, trucks or buses
and the use of any mechanical or powered equipment, vehicles and devices
as well as the parking of automobiles, trailers, carts, wagons, sleds,
cycles or any other vehicle or means of conveyance in any area not
clearly designated for such use.
M. In any manner pull, injure or break any flower, fruit, plant, tree,
grass, turf, pump or water fixtures, or any other structures.
N. Write, paint or carve on any tree, bench or other structure.

Any person, persons, firm, corporation, partnership or legal
entity found engaged in any unauthorized activity or using any Borough-owned
property or parks, recreation areas or public property without prior
authorization, or otherwise violating any provisions of this chapter,
shall, upon conviction thereof, be sentenced to pay a fine of not
more than $600 and costs of prosecution, and, in default of payment
of such fines and costs, to imprisonment for not more than 30 days.
Provided, the fact that a violator has been penalized, after hearing,
as herein provided, shall not preclude the Borough or other injured
party from taking the proper legal action, including actions in civil
court for damages or in equity for a writ of injunction.
