§ 140-1 Permit required for transporting household goods in bulk.

No person or persons, firm or corporation shall move or cause to be moved, from any place within the Borough of Stockertown to another place therein or place beyond the limits thereof, or from any place outside of the Borough of Stockertown to any place therein, any household goods in bulk, without first securing from the Police Department of the Borough of Stockertown a permit for such moving or transportation.

§ 140-2 Application for permit.

Any person or persons, firm or corporation desiring such a permit for the removal or transportation of household goods in the manner above described shall make application to the Police Department of the Borough of Stockertown, setting forth his, its or their name and address, and also setting forth the names of the owners or reputed owners of the property to be moved, the address and location from which the property is to be removed, and the new address or location of the place to which the property is to be moved.

§ 140-3 Issuance of permit.

The Police Department of the Borough of Stockertown shall, upon application being made as provided for in § 140-2 of this article, issue a permit for which a charge, in an amount as set by resolution of the Borough Council,

will be made, setting forth the name of the permittee as well as the name or names of the owners of the goods to be moved and the address from which the goods are to be moved and the address to which the goods are to be delivered. This permit shall be signed by the police officer in charge at the time.

§ 140-4 Violations and penalties.

A.

Any person or persons who violate or permit a violation of this article, upon being found liable therefor in a civil enforcement proceeding, shall pay a fine of $600, plus all court costs, including reasonable attorneys' fees, incurred by the Borough in the enforcement of this article and, in default of payment of such fine and costs, imprisonment for a term not exceeding 30 days. No judgment shall be imposed until the date of the determination of the violation by the Magisterial District Judge and/or court.

B.

If the defendant neither pays nor timely appeals the judgment, the Borough may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Borough are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
